The Commission for Protection of Competition (CPC) has found that the National Railway Infrastructure Company has abused its dominant position in relation to the operation of the public railway infrastructure and on the market for the distribution of traction power on the traction power network, the Commission said on Wednesday.
The operation of the National Railway Infrastructure Company can prevent, limit or disturb competition on the rail freight transport market and affect the interests of consumers through the implementation of an exhaustive strategy for discriminatory treatment, placing BDZ freight division in a privileged position compared with the other rail freight transport companies.
The Commission has established the National Rail Infrastructure Company has dominant position on the market for activities related to operation of the rail infrastructure, which is crucial to the rail freight companies which operate in the country.
Since 2010 the National Rail Infrastructure Company has implemented a strategy for putting the BDZ freight division at an advantaged position, as the two are subsidiaries within the same holding.
A competitive rail freight transport market is increasingly important to the consumers and the businesses in Europe because of its key role in the building of a green and sustainable economy of the future. The strong market position of the National Railway Infrastructure Company requires of it to provide non-discriminatory access to the infrastructure it operates to licenced transport companies.
