site.btaConstitutional Court Opens Case Regarding Appointment of Energy and Water Regulatory Commission Chair

The Constitutional Court instituted a constitutional case at the request of MPs from the 47th National Assembly to establish the unconstitutionality of a parliamentary decision of from February 9, 2022 for the election of a chairman of the Energy and Water Regulatory Commission (EWRC),  informed the official website of the court.

The request was made by the GERB-UDF parliamentary group. According to them, the procedure for the election of the EWRC chair has started when certain material prerequisites, for requirements that the candidate for EWRC chair must meet, were in force, and has ended with different ones.

According to GERB-UDF, the elected chairman of the EWRC does not meet the legal requirements at the time of his nomination for the position, as well as after the legal changes, and is unconstitutional.

At the moment, by a decision of the National Assembly from February 9, the chairman of the EWRC is Stanislav Todorov, nominated by Continue the Change. He was elected by 128 votes to 13, with no abstentions.
