site.btaConstitutional Court Opens Case on Parliament’s Resolution to Provide Military-Technical Assistance to Ukraine

The Constitutional Court has opened a case on the petition of 50 Members of Parliament from the Vazrazhdane and the BSP for Bulgaria groups. They request the court to declare unconstitutional two resolutions of the National Assembly of November 3 and December 9, 2022 related to providing military-technical assistance to Ukraine, the court said on its website Monday. The resolution of January 3 also includes the formula of “building Bulgaria’s defence capacity”. 

Justice Yanaki Stoilov is the rapporteur appointed on the case.

The principle of division of powers has been violated with these resolutions, the arguments attached to the petition claim, as well as that this is a case of direct interference on the part of the legislative power in the field of the executive.

The law ratifying the agreement on the provision of armaments, equipment, and ammunition between the Bulgarian and Ukrainian Ministries of Defence was promulgated in the State Gazette on December 23, 2022.
