site.btaState Consolidation Company Probably Managed Illegally in Last Months, New Executive Director Says
Due to a legislative violation by the previous minister of economy and industry, all decisions of the State Consolidation Company (SCC) taken in the last months might turn out to be invalid, the new SCC head, Ventsislav Dimitrov, commented on Bulgarian National Radio on Thursday. An analysis is being carried out of the SCC’s state in the course of which a series of alarming facts emerge.
Dimitrov said that under the law, a big enterprise such as the SCC should be managed by a board of directors of at least five and not more than nine members. By a decision of former economy minister Korneliya Ninova, however, they were only four. In the past, the Supreme Court of Cassation found invalid such decisions taken by fewer members than the required minimum, Dimitrov recalled.
In his words, this means that the ex-minister not only broke the law but also created a possibility for all decisions of the SCC and some daughter companies to be referred to the court. For example, personnel changes in daughter companies made by the four-member Board of Directors are in effect illegitimate.
The previous SCC executive director, Smilyana Nitova, individually set herself a compensation of six monthly salaries in case she ever got removed from office for whichever reason, Dimitrov went on to say. She held meetings of the Board of Directors by herself and then adopted decisions, the ongoing probe shows. “That claim is still being checked but there are many facts confirming it,” he added.
Contrary to what the previous economy minister has stated, the SCC has not yet paid the dividend of some BGN 10 million owed to the State under the law, Dimitrov said.
